Terms of service

These terms govern your use of EchoMention (the “Service”), provided by Learning Machine LLC, Azerbaijan, Baku (“we”, “us”). By creating an account you accept these terms. If you use the Service on behalf of an organisation, you confirm that you may accept them for that organisation.

1. The Service

EchoMention searches publicly available online sources for keywords you configure, stores matching items with a sentiment score and sends digests to the channels you choose. Results depend on third-party sources that we do not control; we do not guarantee that every mention is found or that sentiment scores and AI summaries are accurate.

2. Accounts

You must give a valid e-mail address and keep your password confidential. You are responsible for activity in your account. You must be at least 16 years old to use the Service.

3. Plans, payment and cancellation

• The Free plan is free of charge. Paid plans are billed monthly in advance: Pro $19/month, Business $39/month (plus taxes where applicable). Plan limits are described on the pricing page.
• Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. The Paddle buyer terms apply to your purchase.
• Subscriptions renew automatically until cancelled. You can cancel at any time from the billing page; the paid plan stays active until the end of the current billing period and then changes to Free. Our 14-day money-back guarantee is described in our refund policy; refunds are processed by Paddle.
• When a workspace moves to a plan with lower limits, keywords, sources and channels above the new limits are paused, not deleted, and mention history beyond the new plan’s retention period is deleted.
• We may change prices with at least 30 days’ notice by e-mail; the change applies from your next billing period and you may cancel before it takes effect.

4. Acceptable use

You agree not to use the Service to stalk, harass or profile individuals, to monitor special categories of personal data, for any unlawful purpose, or in breach of the terms of the monitored platforms. You must not try to break, overload or reverse engineer the Service, share accounts to evade plan limits, or resell the Service without our written permission. You are responsible for your keywords and for how you use the results, including compliance with data protection law where you act as a controller of the mentions you receive.

5. Content and intellectual property

Mentions are excerpts of third-party content with a link to the original; rights in that content remain with its owners. The Service, its software and branding belong to us. You keep all rights in the data you provide; you grant us the right to process it only to provide the Service, as described in the privacy policy.

6. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may change or discontinue features, including sources whose providers change their terms or APIs. We will give notice of material changes to paid features.

7. Liability

To the extent permitted by law, the Service is provided “as is”, and our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim. We are not liable for indirect or consequential damages or lost profits. Nothing in these terms limits liability that cannot be limited by law, including for intent, gross negligence or injury to life, body or health, or your statutory rights as a consumer.

8. Termination

You may delete your account at any time. We may suspend or terminate accounts that breach these terms, after notice where reasonable. After termination your data is deleted as described in the privacy policy.

9. Changes to these terms

We may update these terms. We will tell you about material changes by e-mail at least 30 days before they apply; if you do not agree, you may cancel before then.
